Hello my name is Michelle Timberlake. I was as of 9-27-06 a black female and only black female truck driver for Roadway Express here in Meridian MS. I had suffered a lot of discrimination as well as sexual harassment and harassment. I filed a complaint with EEOC about 6 months ago on racial discrimination and harassment and sexual harassment. I later in March filed extra charges because a white male by the name of Victor Quintero decided to take all of his clothes off and sit in the passenger side of the sleeper truck that we were in and asked me to masturbate with him. I phoned a job steward by the name of Ray Larkin who told me to report it when I got in. I did and hell has broken loose.
First I was called a liar so I asked that Victor and I take a Polygraph test. Roadway would not do it. Roadway Express because they offered me $100,000.00 and they wanted me to resign and they tell my colleagues that I left do to family problems. I refused and was set up to get fired om 9-27-06.
This is already out in the public and in the news media I have permission from my attorney to make this even more public

This is the long version of the case. Do I have a case? What is my 1st step (i’m in Long Island)

I am a middle aged man with a wife and 2 kids. I have never cheated and I am totally respectable (house in suburbia, soccer on sundays with the kids, all that jazz). Work has become horrible to me and this is why:
Around Christmas 2010 I attended an audit at my agency. During this time I was given an assignment that required me to go off with an attractive coworker who I am good friends with and pick through files. This left the conference full of my direct supervisor and three other supervisors throughout the agency. After I left, I later found out, MY supervisor made a snide coment that I was probably having sex with this girl. I am not a prude and I understand that it was said in jest but it gets even more complicated.
A week or so after “the incident” I found out (from a supervisor) that other buildings , people I didn’t know, were talking about it as if it is true. At the time I thought nothing of it until I called the girl I was supposedly having relations with for a work related purpose and was met with “have you heard what they are saying….apparently your supervisor said we are banging”.
OK…..I was also applying for promotions at this time and had to interview with the very supervisors she decided to make thsi story up to.
All I could HONESTLY think was…”wow! I look like a 33 year old scumbag who has 2 kids and cheats on his wife. WOULD YOU GIVE ME A PROMOTION?”
I then PROFESSIONALLY approached my supervisor to tell her that i was not happy with the comment and that I would appreciate it if she kept those comments to herself. I WAS MET WITH LAUGHTER IN MY FACE! I was being serious and was being laughed at?!
Then she decides to give me a performance review for the first time in 5 years and gives me a poor review (citing isolated incidents from 3-4 years ago). I wrote a 3 page rebuttal to her statements and attached it ot the evaluation.
I was brought in a few days later to discuss my evaluation with the HEAD QUEEN of the agency and my supervisors supervisor. 2 big wigs. During this time i was asked for specifics into my problems at work. I unloaded the truth and went all out rat.
To counter my truth and my letter I was “asked” to move out of the building and set up shop under a new female supervisor. It was to be a fresh start and I agreed and was reassured several tImes that it was NOT a punishment. My last few days in the building I was told by a 100% trustworthy source that she overheard that my supervisor had been written up for it. I was not told of this however.
In my first few weeks there I have been made to feel as though it was a punishment and treated rather childishly. I know that a few people know of my complaint and I think it has spread and that I am being ostracized and “pushed” out.
I WORK ALL DAY LONG, HAVE NEVER BEEN CITED, I AM A PROVEN COMMODITY AT WORK AND AM A VERY NICE GUY.
I came home to day shaking because I don’t want to quit but it is giving me unneeded grief.
I have a few inappropriate emails that the perpatrator of the rumor sent me as well as the entire performance review on a voice recorder. (there is no talk of the offense but it proves that she wrote the things she wrote directly after my confrontation with her).
I also have a voice recording of her saying how I am “not the type of guy you would want to wine and dine and that I am the type of guy you want to just throw down.”.
I was set up to get her voice recorded admitting the whole thing (she has) but the recorder in my pocket turned off.

Do I have a case?
I want these people to understand that they have made me ill over this and I want the agency to pay me.
What are my odds.

I work at a “Christian” daycare..A “teacher” in the center copy/pasted a conversation that DIDN’T exist, edited it with her own words…and had her daughter mail it to the director. This “convo” that took place was supposedly between myself and another teacher, but was totally a lie. However, we were called in for a meeting with the daycare board, and questioned. Well, of course I pointed out that it was clearly fake and we both denied having any involvement. The teacher that did this wasn’t even a friend of ours on facebook..The convo said the word “Bitc@ ” two times and the word “psych” in front of the “B” word..anyway, it is false. But now the board members and director keep meeting with us, have told outsiders and other coworkers about the situation. To top it off, the pictures used on this “fake” convo wasn’t even the pics we use on our profiles. The pic they used of mine was a pic of my 5 year old niece. Then the board members photocopied this article and are passing it out to other members, as well as us. I don’t know the laws of the pictures of minors being passed out, especially at a daycare, but it doesn’t seem right. So, the members keep wanting to meet with us, and have done so already twice. Tomorrow they want to meet with us again. They keep asking us over and over if we had any involvement. i am starting to feel harassed by them. I also feel that since this is clearly fraud or something along those lines, I should use the legal system? What are my rights as an employee and as a victim of these lies?
Ok, it’s clear to the other teacher involved and the daycare board that this document has been edited. The font, font size, and many other things are different from what an actual facebook posting appears. It’s obvious that it has been altered. We printed out an original page from facebook showing them what an actual posting looks like. I’m not going to lose my job, but the meetings are getting ridiculous. I understand they have to investigate, but there are so many other circumstances to this situation that there isn’t enough time to explain. I spoke to a police office who told me that people setup fake accounts all of the time. That I should get an attorney and not meet with the board again until meeting with my attorney.

Workplace Harassment….how to handle…..?

I have been working at a church for the past three and half years. I have been consistently harassed since my initial employment here. A fellow co-worker has been rude to me in ways I never thought could be. She has placed Windex in my food, has called me names as she has walked by office (i.e. fat, ugly, bitch, whore, bad mother), she has stolen mail from my mailbox, lied to the other co-workers and members of the church stating that I am unclean, and has used those names. She has also given my number to members of the church and they have contacted me threatening me about the things she has told them about me and has told me to watch my back. She talks down to me like I am a dog and tells me to be obedient and pats me on my head like I am a dog. I have also had a similar incident where she has placed her hands on me. I went to put mail on my boss’ desk. The next day, my boss asked me about the mail and I told him it was on his desk where he had asked me to put it. I asked him if I could look around the office some more and he told me yes. I did not find it and then took the blame for it missing. I then walked to my desk and was followed by her. She asked me if I had found it and I told her no. She then walked away and called me a ditzy bitch. I ignored. I went to report it to my boss and she then follows me and puts her hands on me, dragging me back to my office. I scream and punch the wall hoping that will make her leave me alone and she then left me alone. I reported this boss and he gave me another Bible verse to read.

If you are asking the question, as to whether or not I have reported this to my boss, the answer is yes and he gives me a Bible verse to read. This does not handle the situation at all. This makes things worse because it makes it seem like she is not in the wrong for what she is doing and then feels it is okay to continue it.

I feel it would be best to get a lawyer to handle this issue. It is not the church as a whole that is bad, it is this one co-worker. Is there anything else I can do to make this stop? I am looking for another job by the way.
